Introduction

Any products or services relating to the games (referred to as Services) offered by Winner Games & Technologies Pvt Ltd and its subsidiaries, sister concerns, and partners through our Website, www.deccanrummy.com (which will be referred to just as "Website") are framed with these Terms of Service (affiliates which are referred to as the "Terms"). It includes Help, Privacy Policy, Add Cash, My Account, Promotions, and Bring-A-Friend sections and the subsections of these sections on the Website.

Players are requested to comply with and abide by the terms and conditions even if they are modified.

DeccanRummy has the discretion to deal with a violation. Users are sternly warned to comply with the rules.

Legality

GST Policy

• The Finance Ministry has notified Oct 1 as the appointed date for the amended Central and Integrated GST laws to implement 28% GST on Online gaming sites.
• Effective Oct 2023, given the insertion of Rule 31B of the CGST Rules, 2017, Winner Games shall levy an applicable 28% GST on the amount deposited by you and will deposit the collected amount to the government treasury. We shall issue an invoice for your deposit, and GST collected thereon. The amount deducted as GST will be credited as a cash bonus to your account. TDS Policy

• We are obliged to deduct tax at source on your net winnings by the applicable law as prescribed by the government of India. To ensure we comply, you must furnish your PAN, which IT authorities have issued. We reserve the right to verify your PAN from time to time. Withdrawal of winnings to your bank account will be permitted only when you provide the correct PAN details.
• Presently, TDS at the rate of 30% prescribed by law will automatically be deducted from the net winnings at the time of withdrawal and/or at the end of the financial year on untaxed winnings. Kindly note that the rates are occasionally subject to change as per government policies. Our obligation ends with deducting TDS and providing you with a tax deduction certificate. You acknowledge that we are not responsible for anything related to your personal tax filing
• While winning a prize with goods or cash, the TDS will be borne by you, and we are required to ensure that TDS is collected before the prizes are provided to you. Please note that the TDS Act complies with the Finance Act of 2023, and the Company reserves its right to modify/alter/amend the policy as per government instructions.

Service Charge

DeccanRummy provides valid, registered Users with the opportunity to access and play online games of skill. Our Company provides software and IT services to enable skill games to be played with other individuals over the Internet. The Services provided by our Company are only intended to facilitate games of skill. DeccanRummy levies a service charge for all Cash Games, including applicable service tax. The Service Charge may vary occasionally and from one cash game to another.

User Representations

• We require true and authentic information during registration or any other time.
• You must ensure you are aware of the legality of playing Cash Games in your state while participating in our cash games. Creating User Accounts

• Your deposits cannot be transferred to any other registered account except in cases permitted by DeccanRummy, which is subject to restrictions and conditions.
• We rest the responsibility of providing correct information about yourself on your shoulders. We do not cross-verify the information that you have provided, and we are not responsible for any result of you providing incorrect information and concealing factual information.

Validating User Accounts

DeccanRummy might validate user accounts from time to time. For verification, attempts can be made via phone calls or Email. If we can't reach you for the first time, we will make additional attempts to establish a connection with you. But if an incorrect phone number or email address is given, we bear no responsibility when the service is interrupted.

If the validation process is unsuccessful, we can exercise our right by disallowing you from logging into our Website, reducing your play limits, and Add Cash limits until your account gets verified properly. • If the user ignores our instructions, their account will be subjected to termination.

Action against Cheating and Colluding

• Games must be played individually after registration. Cheating attempts may include seeking external assistance to win the game using bots or cheat codes or hacks attempting to modify the Website using third-party software.

Colluding with others and transferring funds to or from other players, attempting to make cash credits through credit cards, or attempting withdrawals without participating in cash games.
• Multiple IDs: A user can only have one registration ID for our Website. Multiple registrations for a user are strictly not allowed.

• Chips Dumping: Losing chips intentionally to another player on purpose. Chip dumping is considered illegal by all the rummy online websites. Players chip dump for multiple reasons. • Winnings, bonuses, and prizes are unique to the Player and cannot be transferred to anyone. If it is found that you are attempting to transfer any winnings, bonuses, or prizes, those would be forfeited.
• If you are an employee, consultant, or agent of DeccanRummy or a relative of such persons ("Associated Person"), then you are not permitted to play, either directly or indirectly, any Games that entitles you to any prize on the Website, other than in the course of your engagement with DeccanRummy. The term' relative' includes spouse and financially dependent parents and children.
• You must not trade, rent, lease, license, purchase, sell, grant a security interest in, or transfer your user account, content, currency, points, standings, rankings, ratings, or any other attributes appearing in, originating from, or associated with the Website.

• If you are from Winner Games or any of its sister concerns/partners, you are not permitted to play directly or indirectly
• Accessing someone's account is strictly prohibited. Winnings, bonuses, and prizes of any kind are non-issuable in that case
• You must not frame the Website. You may not impose commercial material, editorial comments, or any information on the Website, alter or modify content, remove, obliterate, or obstruct any proprietary notices or labels.
• Indulging in fraudulent activities like attempting to use someone else's bank account details, credit cards, debit cards, net banking usernames, passwords, authorization codes, prepaid cash cards, and mobile phones for adding cash to your user account are considered serious offenses, and it is strictly prohibited.

In addition to the action, we can exercise our right to remove any or all the material or comments you posted and restrict your access to any media available for public access that is controlled or moderated by us.

Payments

• Transactions on our websites can only be made in Indian Rupees
• All the transactions in your account are recorded in your user account once you register with us. All the payments required to participate in cash games at DeccanRummy should be made through this account. The cash prizes you win will be credited to this account.
• Payments through credit cards, debit cards, and Internet banking will be processed through third-party payment gateways. Deccanrummy will not be responsible for any delays or denials in payment processing.
• We reserve the right to cancel a transaction at our discretion. The transaction might be reversed if the payment is booming, and the money will be credited back to your financial instrument.
• We suggest you use your own financial instrument to pay for your account. You can deposit as much money as possible into your account subject to the Add cash limit when we specify it.
• We hold the players' funds in trust and will remit them to the players in due course, subject to the terms for withdrawal of funds. Funds from our players are maintained separately from our corporate funds. Even in critical situations like insolvency, player funds will be given preference over other claims

Withdrawing money from the user account

At present, players can withdraw their winnings through electronic bank-to-bank transfers.

• In order to prevent money laundering, we have imposed certain restrictions on withdrawals. A player must have used his deposit to generate loyalty points at a ratio 10:1, in order to withdraw the deposited amount. Eg: For example, if the Player has deposited Rs. 5000 then he should use the funds to generate at-least 500 loyalty points in order to be eligible for withdrawing the amount he has deposited else bank transaction charges will be applicable.

Refund Policy

We shall not be held accountable for any interruption in Services, and players must hold themselves responsible for any risk of loss due to Service interruptions at their ends.

If the Player is unable to play a game due to a disruption that can be attributed to DeccanRummy, the settlement of such games will be done as per our Games Cancellation Settlement Policy.

Reasons for User Account Suspension

DeccanRummy reserves the right to suspend or otherwise restrict the Player's access to our Services on our Website during investigation for any of the below-listed reasons:

If we suspect a violation of Terms or any other abuse of your user account.

• Cheating, Collusion, or any malpractice attempted by the players
• If there are charge-backs on the Player's user account.
• If a breach of security of your account is suspected
• The decision to suspend or restrict the services or any part that we consider appropriate would be final and binding on you.

Breach of Terms and its Consequences

In case we detect a breach of terms and conditions during our investigation or if there are elements of doubt that your continued access might be detrimental to our interests or any other users, or even the general public, DeccanRummy has the discretion of taking the following actions:

• A player's user account can be permanently suspended
• Cash balance in the Player's account can be forfeited

• We have the right to restrict games between users who are suspected of colluding or cheating;
• We can initiate prosecution for violations that amount to offenses according to law. Damages could be claimed for breach, and we possess the right to initiate civil against the Player to recover damage charges
• DeccanRummy's decision to initiate action to be taken on such breaches shall be final and binding on the Player
• DeccanRummy's action against players who breach our terms and conditions would be taken without prejudice to the rights and remedies available in law or equity.

Modification and Alteration to Terms

Limitation of liability
